Retail Online, On-Demand, Gig Economies and the Data and Fraud Risk Considerations Associated with Them
The rapid expansion of digital commerce in South Africa has created significant opportunities while simultaneously raising critical regulatory, security, and labour considerations.
First, online trading demands careful attention to data privacy and intellectual property (IP) protection especially when using third party platforms, like a marketplace, WhatsApp business and even social media platforms. With the enactment of POPIA, businesses must ensure that customer data is collected, stored, and processed lawfully, while also safeguarding proprietary content and brand assets against infringements and counterfeits in an increasingly borderless digital market. Even the manner in which we market to our customers must adapt.
Second, the growth of e-commerce and online payments has amplified cybersecurity and fraud risks. Phishing, identity theft, and financial fraud remain pervasive threats, requiring robust cyber-security frameworks, encryption, PCI compliance considerations and consumer education to build trust and resilience with digital platforms.
Finally, the rise of gig economies and on-demand service models is reshaping the future of work in South Africa. While these flexible arrangements drive innovation and employment, they raise complex questions for labour law—particularly regarding worker classification, minimum protections, and unfair labour practices. South Africa’s labour framework, traditionally designed for full-time employment, must evolve to balance worker rights with the agility that platform-based services demand.
